Our platform connects travelers and locals for curated, unique, and interactive experiences. By accessing or using our services, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please discontinue use of the platform.
1. Definitions
- "Company": Refers to Live Like NYC, LLC.
- "User": Any individual accessing or using the platform, including customers and Guides.
- "Guide": Independent contractors offering experiences through the platform.
- "Experience": Any tour, activity, or service facilitated by a Guide via the platform.
2. Use of Platform
- Users and Guides must create accounts to use our services.
- Eligibility:
- Users must be at least 18 years old or have parental or guardian consent to create an account.
- Guides must meet all eligibility requirements outlined in the Guide Agreement.
- The Company reserves the right to suspend or terminate accounts for violations of these Terms or misuse of the platform.
3. Bookings and Payments
- Booking Process: Users may browse and book Experiences through the platform. Guides must confirm all bookings.
- Payment Terms:
- Payment is required at the time of booking through the platform's secure third-party payment system.
- Users agree to pay the total booking amount, including applicable taxes and fees.
- Cancellations and Refunds:
- Users may cancel bookings up to [Insert Time Frame] prior to the scheduled Experience for a full refund.
- Cancellations made after the allowed timeframe are non-refundable unless due to extenuating circumstances.
- Guides who cancel an Experience are required to provide Users with a full refund or the option to reschedule.
- The Company may mediate disputes between Users and Guides but does not guarantee resolution.
4. User Conduct
- Users agree to:
- Provide accurate information during the booking process.
- Arrive on time and prepared for the scheduled Experience.
- Treat Guides, other Users, and LLNYC staff with respect and professionalism.
- Users must not:
- Engage in any illegal, harmful, or disruptive activities while using the platform or during Experiences.
- Harass, harm, or endanger Guides, other Users, or Company staff.
- Post false, defamatory, or misleading content, including reviews or feedback.
- The Company reserves the right to terminate accounts for any conduct it deems inappropriate or in violation of these Terms.
5. Guide Responsibilities
- Guides must:
- Deliver the Experience as described in their listing.
- Ensure the safety and well-being of participants during the Experience.
- Maintain compliance with all applicable laws, licenses, and permits.
- Maintain a minimum rating of [Insert Rating, e.g., 4.5 stars] based on User reviews.
- Guides grant the Company a non-exclusive license to use submitted content (e.g., photos, videos) for marketing purposes.
6. Intellectual Property
- The Company retains all rights to platform content, including text, graphics, logos, images, and proprietary designs.
- Users and Guides may not use, reproduce, or distribute any content without prior written permission from the Company.
7. Limitation of Liability and Release
- Live Like NYC (the "Company") is not responsible for:
- Any injuries, losses, or damages incurred during an Experience.
- Disputes between Users and Guides.
- Technical difficulties or interruptions affecting platform access.
- Participation at Own Risk:
By participating in Experiences offered through Live Like NYC, users acknowledge and agree that they do so at their own risk. The Company is not responsible for any injuries, damages, or losses incurred during Experiences, except to the extent required by applicable law. - Authorization of Image Use:
By participating in Experiences, users grant Live Like NYC a perpetual, royalty-free, worldwide license to use, reproduce, and distribute their image or likeness for marketing and promotional purposes. This includes, but is not limited to, use on social media, advertisements, and the Company’s website. If users do not wish to grant this license, they must notify the Company in writing before participating in the Experience. - Third-Party Indemnification for Image Use:
Live Like NYC is not responsible for the acts of third parties, including Guides, vendors, or other participants, who may independently capture or share users' images or likenesses. Users agree to indemnify and hold harmless the Company from any claims or liabilities arising from such third-party use of their image or likeness.
8. Reviews and Feedback
- Users may leave reviews and ratings for Guides and Experiences.
- By submitting feedback, Users grant the Company the right to use, display, and publish such content on the platform and for promotional purposes.
9. Dispute Resolution
- All disputes arising from these Terms or use of the platform must be resolved through binding arbitration in [Insert Jurisdiction].
- Users waive their right to participate in class-action lawsuits.
10. Modifications to Terms
- The Company reserves the right to amend these Terms at any time.
